Rehearing denied March 22, 1955. The plaintiff, James P. Hall, brought suit under the Federal Employers' Liability Act (45 U.S.C.A. 51-60) to recover damages
for personal injuries sustained on August 11, 1947, while he was employed as switchman by the defendant, Chicago and Northwestern
Railway Company, a common carrier engaged in interstate commerce. On May 7, 1952, the jury returned a verdict for the plaintiff
in the amount of $50,000, and the court entered judgment thereon. The defendant filed a motion for judgment notwithstanding
the verdict, and the plaintiff moved for a new trial. The court denied the defendant's motion, but allowed the plaintiff's
motion for a new trial.
